Terms of Service

1. About these terms
Crew is a service of Tolmon Ltd, a company registered in England and Wales (Companies House number 14468414), with its registered office in London. References to "we", "us" and "our" mean Tolmon Ltd. References to "you" and "your" mean the person who creates and uses a Crew or DriveOps captain account.
These terms govern your use of the Crew member service at crew.driveops.uk and the DriveOps captain application at app.driveops.uk. They apply alongside the Crew privacy policy, which is published at driveops.uk/privacy.
By creating an account, ticking the "I agree to the terms" box, or otherwise using either service, you accept these terms. If you do not accept them, please do not use the services.
2. Eligibility
You must be at least 18 years old to create a Crew or DriveOps captain account. We do not knowingly accept registrations from anyone younger.
If you are signing up as a driver, you confirm that you hold the full UK driving licence, motor insurance, and any other licences or permits required for the vehicle work you intend to be booked for. You confirm that the documents you upload as part of verification are genuine, current, and lawfully yours to share.
If you are signing up as a captain, you confirm that you represent a legitimate UK film, television, advertising, or related production company and that you have the authority to act on its behalf when inviting drivers and offering work.
3. Your account
You are responsible for keeping your password and any other login credentials confidential. Treat them like the keys to your house.
Each person may hold one Crew account and one DriveOps captain account. Sharing an account with another person is not permitted, and the account holder is responsible for all activity that takes place under their login.
We may suspend or close an account that breaches these terms, that poses a safety or fraud risk to other users, or where required by law or by a competent authority. Where it is reasonable to do so, we will contact you before taking action and explain the reasons. The moderation process is described further in the in-app reporting flow.
4. Subscription terms (drivers)
The Crew driver service is offered as a free tier and a paid Pro tier. The free tier is available for as long as we operate the service, subject to these terms.
Pro tier pricing at launch is £19 per calendar month or £190 per year, charged in advance through Stripe. Stripe is the payment processor; its own terms apply to card processing, and we never see your full card details.
Cancellation takes effect at the end of the current billing period. We do not refund partial months or partial years.
If this is your first paid subscription with us, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 calendar days from the start of the subscription to cancel for a full refund, provided you have not yet had substantial benefit of the service. After the 14 days have passed, the cancellation terms in the paragraph above apply.
If we change the price of the Pro tier, we will give you at least 30 days' notice by email and on the billing page before the new price applies. If you do not want to continue at the new price, you can cancel before it takes effect.
5. Subscription terms (captains)
The DriveOps captain service is offered as a free tier and a paid Premium tier. The free tier is available for as long as we operate the service, subject to these terms.
Premium tier pricing at launch is £29 per calendar month or £290 per year, charged in advance through Stripe under a separate Stripe product. The cancellation, refund, statutory cooling-off, and price change terms in section 4 apply to captain Premium in the same way as they apply to driver Pro.
6. Acceptable use
You must not use either service to:
- harass, threaten, defame, or discriminate against another user;
- impersonate another person or misrepresent your identity, company, or qualifications;
- post or share content that is unlawful, fraudulent, hateful, or sexually explicit;
- send spam or bulk unsolicited messages, except through the captain Premium bulk message feature within the limits described in-app;
- scrape, harvest, or otherwise extract data from either service by automated means without our prior written agreement;
- reverse engineer, decompile, or attempt to circumvent the technical controls that protect the service;
- upload viruses, malware, or other harmful code; or
- use the service in a way that interferes with normal operation for other users.
You can report breaches of these acceptable use rules through the in-app reporting flow. Reports are reviewed by our moderation team.
7. User-generated content
You keep ownership of the profile content, messages, ratings, reviews, and other material you submit through either service. You grant Tolmon Ltd a worldwide, royalty-free, non-exclusive licence to host, store, copy, display, index, and adapt that content as needed to operate the service, show it to the relevant other users, support search, and provide customer support. The licence ends when you remove the content or close your account, except where the content is part of another user's records (for example, a rating you gave a captain).
You are responsible for making sure that the content you post is lawful and that you have the rights to share it. You must not post content that infringes the intellectual property or privacy rights of any other person.
8. Verifications
Where Crew shows a verification badge on a profile, it means we have checked the supporting document against public records, where available, to a reasonable standard. A badge is not a warranty of any kind and does not guarantee that the underlying licence, insurance, DBS, or MOT remains valid at the time you read the profile.
Captains must run their own due diligence before hiring a driver, including confirming current licences and insurance directly with the driver and, where appropriate, with the issuing authority.
Drivers must keep their verifications current. If a licence is suspended, an insurance policy lapses, or an MOT certificate expires, you must update or remove the document promptly and stop accepting work that depends on it.
9. Limitation of liability
The service is provided on an "as is" basis. To the maximum extent permitted by law, Tolmon Ltd's total liability to you under these terms, whether in contract, tort, or otherwise, is limited in aggregate to the total subscription fees you have paid us in the 12 months immediately before the event giving rise to the claim.
We are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of goodwill, or loss of data, even where such loss was reasonably foreseeable.
Nothing in these terms limits or excludes our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot be limited or excluded under the laws of England and Wales.
10. Termination
You can close your account at any time through the in-app account settings, by emailing info@tolmon.com, or by calling the deletion endpoint described in the privacy policy. We can close your account at any time, with reasonable notice except where a breach of these terms or a safety risk justifies immediate closure.
When your account is closed, the retention and deletion timetable in the Crew privacy policy applies to your personal data. Some content, such as ratings you have given to a captain or messages sent to other users, may remain visible to those other users for the period set out in the privacy policy.
11. Changes to these terms
We may update these terms from time to time. If a change materially affects your rights or obligations, we will give you at least 30 days' notice by email and through an in-app notice before the change takes effect. Other changes, such as a correction of a typographical error, take effect immediately and are noted in the "Last updated" date at the top of the document.
Continued use of the service after a change takes effect counts as acceptance of the new terms. If you do not accept a change, you can close your account before it takes effect.
12. Governing law and disputes
These terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim, except that, if you live in Scotland or Northern Ireland, you may bring proceedings in your local courts.
Nothing in these terms affects your statutory rights as a consumer under United Kingdom law.
